“REDUNDANCY” IS NOT A LEGAL LOOPHOLE: THE RM152,000 WAKE-UP CALL

Date: 21.1.2025

This digital podcast details a ruling from the Industrial Court of Malaysia regarding a dispute between Wong Si Jing and China Communications Construction Company. The court examined whether the employer’s decision to terminate the claimant’s contract early under the pretext of redundancy and contract expiry was legally valid. Although the company claimed the role was no longer necessary, evidence revealed the underlying project was ongoing and the claimant’s duties were simply transferred to a foreign national. The chairman concluded that the dismissal was without just cause or excuse, labeling the company’s justifications as arbitrary and unfounded. Ultimately, the court awarded the claimant RM152,000 in financial relief, covering back wages and compensation instead of reinstatement.
